I would test and remove. That is what I plan on doing. And if I get around to testing and not removing, I absolutely will disclose to the next buyer that the floors contain asbestos. If I don't even get around to testing, I 'don't know' unless they change the disclosure to disclose things I think may contain asbestos.
I'm all for honesty. If I could afford it, I'd sue my previous owner for failing to disclose. I just think it is apples and oranges.
