The 10',2'rule is what is code,at least where I'm from.
At a 10' level point from the roof to the chimney you need to be 2' heigher,if you are under 10' away from the roof(because you are close to the ridge)you need to be 2' heigher than the ridge.
This is only because of draft for the fireplace.What Scott R and Harold said is true once the smoke leaves the stack.Luck
