We are having a friendly argument in our condo association over the definition of the "roof surface."
This stems from work that needs to be done on the garage roof.
Our three-flat condo declaration is set up in such a way that any work to the "surface of the roof" is assessed to the first-floor owner, who has exclusive rights to a roof deck, while the remaining cost of any roof work is split among the building's three owners.
Our lawyer has said he can't really give us a definition of "surface" because one doesn't exist in the law. He referred us to roofing companies.
I'm hoping to get some ideas from you guys.
Any idea would be helpful! What, would you say, is considered the "surface" of a roof???
