wet basement walls

I recently purchased a newly constructed home and my yard is not landscaped yet. Since then on heavy rains my basement walls develope wet spots in certain areas. Some large at times and some where the floor meets the block. I am told my builder use a product call form-a-drain to provide interior and exterior drainage. He also sprayed asphalt on the exterior walls below grade. I have never seen any water exit the drain pipe for the drain. He now wants to spray a silicon waterproofing product to my interior walls. Is this a exceptable repair? I dont want to spend alot of money and time on landscapeing if he is going to have to excavate.
