Weep Holes in Brick new construction

I had a home built 7/02 and I've noticed that I'm getting water on the walls in the basement. There were other leaks in the walls in the basement which were sealed, but the company that did the sealing said that they could not do anything from the water that is coming from overhead. What I mean is that when you go outside and look at the house, there is a black tar looking mark on the brick. The man told us that it is the builders who must fix this problem. After sealing around some areas missed on the windows and patching areas where mortor may have been missed, they now want to plug the weep holes. Is this a good thing to do to stop the water. Our landscaping is well below the line, probably 6 inches or so.
