unlevel wood floors

Hi. I'm in a battle with a builder and i have two questions.
I've built a new home and due to an undersized beam the hardwood floor has sunk over one inch. The builder ripped out the ceiling in my basement jacked up the floor and reinforced the beam. The floor still sags about 15/16 of an inch in spots. The builder says that's close enough. My lawyer can't find any definition of "level" (obviously some variance would be ok -not 15/16 of an inch though). Do you know of any published standards?
Second - a home inspector I hired wants the builder to rip up the hardwood and subflooring to level the floor - what do you think. Thats pretty drastic and would require the refinish of all hardwood in my house - most of the house.
