Too hot upstairs.

I agree that your heating and cooling contractor needs to address the problem. With the technology we have today with zoning systems, automatic by pass dampers, radiant heat and the like-there is no reason that a new house can not maintain a comfortable temperature through out. It's possible that there is volume control damper out of adjustment or that there is some other problem with the system.
