Code issues notwithstanding, but with more of a spin on materials: I wouldn't consider using pressure-treated landscape timbers for a retaining wall of that height. You're asking for trouble going above two timbers high in any sort of wall with earth behind it.

Timbers in applications such as those have a high incidence of failure 4,5, and 10 years down the road. If you have to do it, use concrete.
