It seems as thout litigation for this sort of stuff is very very difficult in Canada. We do have pictures of the foundation as the house was being built and the crack is definitely there. They did a pretty good job at covering it up (with parging, insulation, vapour barrier etc...).
My lawyer has indicated that we should just let them fix it and close the door on it.
Does this sound like the concrete is bad?
How can this be avoided?
(the foundation is cracked about 5mm all the way up from the bottom to the top)
