Shower stall problem....

I remodeled my masterbath aprox 3 years ago. I completely gutted that room and installed everything new. I installed a new shower pan made bt American Standard. It was a product called Americast made from acrylic and fiberglass. A few months ago I noticed a drip coming from the ceiling in my Family room while my wife was in the shower. I figured it was from the drain. I decided I would eventually get to the problem so we just used a different bathroom. Today I had a plumber come over to fix the problem (because I no longer have time for stuff like that) He said the problem is not with the drain but with the shower pan which has a few cracks in it around the drain. He had more bad news - I have to rip out all the tiles and shower door etc. to replace the pan...

Does anyone have any ideas? Is American Standard liable if their product failed and caused damage to my home? Even if the warranty is no longer valid? What would you do?
