You should be able to make it work within the 5" between the bottom of the duct and the top of the door frame. Technically you can do it. It depends on what the code says about framing distance from the duct and the minimum header size for a non-load bearing wall.

You could frame the whole wall with a doubled 2X4 top plate (3", giving you 2" to spare for the frame and duct spacing) or with a pair of 2X4s on edge with a 1/2" spacer (3.5", giving you 1.5" to spare for the frame and duct spacing).
