laminate flooring on steps

Please help! I thought laminate was a great choice for my lower level, including steps. I did not see the stair nose molding for the treads until it was delivered. I was shocked to learn it was not flush with the tread. It projects up 3/16th inches (4mm!)My local building code (BOCA)
only stipulates minimum tread depth. The manufacturer"s (Classen USA)response to me was 'the molding is a bit higher than the tread.'Should this be acceptable to me? Thanks, Gina Woodruff
