Posted by Sticky Fence Issue on May 22nd, 2000 03:02 PM

I have a fence (chain link - yuck) that runs along the property line between one neighbor and myself. My neighbor, in a casual conversation a year ago, indicated that she hated the thing as well and would love to see it go. When I approached her this spring, she indicated differently -- that she liked the fence and would like to see it remain. (I'm willing to PAY for any new fence thats put in its place, as well as PAY for the old fence's removal). Here's the problem: The fence crosses our property line (its partially clearly in my yard and partially clearly in her yard). If I were to put up a fence, I would make sure it was ALL in my yard to solve any issues in the future, but any fence I'd want to put up would require that the old fence come down (i.e. I don't want a privacy fence)...

What options do I have here, based on general legal principles?
