That your plumber meant to seal the bottom of the air gap where it meets the counter, and not to seal up the air gap completely. Without an air gap, it is possible to draw back dirty water from your drains into the dishwasher.
It sounds to me like you may have a bad air gap. When does it leak? Just when the drain cycle starts, or during the entire drain cycle? Does it spit out momentarily or leak continuous?
If is possible that you have too much backpressure in the drain line, causing the airgap to leak.
My vote would be to replace the airgap with a top of the line brand.
