I had almost the same problem with our house built in 1901. We have heat ducts upstairs but the insulation was so poor it got up to 100 degrees in the summer and stayed cool in the winter. We did add another outlet upstairs but the main thing that helped was to add a cold air return upstairs. Since heat rises, all the heat in your house is going to go upstairs. A return upstairs will circulate the hot air out of the upstairs and back through the house. It will also save you a lot of money on your electric bills.
As far as your contract goes, I agree you should make the seller pay for the work or or reduce the price of the house with the appraised value on heated square footage. I would also get a different real estate agent. The one you have is not doing there job. You are not obligated to buy the house as is. Bob
