Dear Bell,

I had already written an answer and my dear wife walked by and pulled out my here is a tamed down version of what I had written before.......

Your contractor is wrong. Specs are specs, and it asked for four inches. He should have installed four inches. Just because he "forms" the concrete with a 2x4 means nothing.

Document this problem, via your attorney if you want to do it right, for future "possible" problems. I don't know how this slab is being utilized, the soil condiditions, etc., so I cannot really give you more information. But, the contractor should be made liable for his error. If he balks, tell him he can remove it and do it right. And, while he is at it, go to school.
