Chunk/crack in fiberglass tub/shower

I am building a new house with a builder and when they were installing the garden tub piece in our bathroom, they cracked it. (This was a the frame stage) After a fight, they agreed to replace it. Now we are less than two weeks to closing and we noticed they somehow they have managed to crack the new one!! It is not a line crack, but a chunk that is cracked and peeling. I am sure since the house is complete (drywalled) that they are not going to want to replace it. Can it be patched? It is located on the wall part but near the shelf. If we patch this is it going to last? Or should we refuse it unless they replace it? How long will it take to knock drywall and studs out? HELP professionals!!
