Even so, maintain appropriate clearances. Sure, it's just being used for you Hot Water Heater today, but what happens 10 years from now when the house is sold & someone else decides to use the chimney for something else.

As far as air leakage is concerned, it wouldn't matter if the chimney wasn't being used at all, the firestop aroung it must be airtight.
