Check with your local Inspection Department, then see if you have covenants on your deed and how long they run. If there are covenants, see who enforces them. Developers will often pass that on to the Home Owners.
In my development, we had to form a legally registered Home Owners Association for the purpose of enforcing the covenants.
My folks, on the other hand, moved into a development that had not formed an Association and their attorney told them the covenants could not be enforced.
As far as "if it is out of site", my favorite tool in my job is the G.I.S. system that allows me to retrieve satalite photos so clear that I can see a shed without any problem.
In the long run, it's easy to check and if it is not allowed, e-mail me and I will tell you some ways to get around that.
