Another dreaded basement question......

Hi folks. I too, am finishing my basement and have run in to a 'challenge' with installing the fire block for the framing. My top plate is actually about an inch higher than the top of the concrete walls. My question is how to secure fireblock to the top of the 2x4 plate AND to the top of the concrete since they're not flush? I always thought fireblock was installed between the studs, but I'm told by the county folks this needs to be OVER the top plate to stop any potential fire/oxegyn flow. With a one inch gap, it won't serve any purpose. Maybe I'm just out in left field. Can anyone set me straight? Thanks in advance!! Ted
