after claims are paid-owner/builder's obligations to subsequent owners

I'm interested in purchasing a home with the Woodruf roofing. The original owner / builder made a claim in June1997 and was paid 100% towards the cost of replacing the defective roof. He did not replace the roof and sold the house to the current owner without disclosing the fact that the claim had been satisfied leaving no warrenty on the existing roof. I'm having the roof inspected on Saturday the 29th. Even it it shows no evidence of leaking at this time it is doubtful that it will last the 15 years that it was originally warrented. (the house was built in 1994) Is there anything we can do to protect ourselves be fore purchasing this home or is there any recourse we might have against the original builder who was paid for the claim but did not choose to replace the roof?
